KIDS SUMMER CAMP WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION AGREEMENT, MEDICAL AUTHORIZATION, AND NO-REFUND POLICY

IMPORTANT NOTICE

THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY BEFORE SIGNING.

BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

1. PARENT/GUARDIAN REPRESENTATION

I certify that I am the parent or lawful legal guardian of the minor child identified above (“Minor”), who is between the ages of 6 and 13 years old, and I have full legal authority to execute this Agreement on the Minor’s behalf.

I understand the legal consequences of signing this document, including releasing Purrfecto Cat Lounge and related parties from liability and assuming all risks associated with participation in the Purrfecto Cat Lounge Summer Camp (“Camp”).

2. DESCRIPTION OF CAMP ACTIVITIES

Purrfecto Cat Lounge (“Purrfecto”) operates a supervised children’s summer camp program at its Austin, Texas facility. Camp activities may include, but are not limited to:

●     Interaction with cats and kittens;

●     Educational activities;

●     Arts and crafts;

●     Games and group activities;

●     Feeding and caring for animals;

●     Indoor recreational activities;

●     Snack and meal periods;

●     Other supervised camp-related activities.

All activities are supervised by Purrfecto employees; however, accidents and injuries may still occur despite reasonable supervision and safety measures.

3. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS

I acknowledge and fully understand that participation in Camp activities involves inherent and unavoidable risks, including but not limited to:

●     Cat scratches, bites, or other animal-related injuries;

●     Allergic reactions;

●     Falls, slips, collisions, or physical injuries;

●     Exposure to communicable illnesses or infectious diseases;

●     Emotional distress;

●     Property damage;

●     Serious bodily injury, disability, or any other fatal outcome

I knowingly and voluntarily assume all risks on behalf of myself and the Minor, whether known or unknown, foreseeable or unforeseeable, including risks arising from the NEGLIGENCE of Purrfecto Cat Lounge, its owners, employees, contractors, volunteers, agents, affiliates, rescue partners, successors, and assigns (“Released Parties”), to the fullest extent permitted by Texas law.

4. RELEASE AND WAIVER OF LIABILITY

TO THE FULLEST EXTENT PERMITTED UNDER TEXAS LAW, I, FOR MYSELF, THE MINOR, AND OUR HEIRS, EXECUTORS, REPRESENTATIVES, AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, COSTS, EXPENSES, OR ATTORNEYS’ FEES ARISING OUT OF OR RELATED TO:

●     The Minor’s participation in Camp activities;

●     Use of the Purrfecto Cat Lounge premises;

●     Interaction with cats or other participants;

●     Illness, injury, disability, emotional distress, property damage, or any other fatal outcome.

●     Alleged NEGLIGENCE of the Released Parties.

5. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, judgments, settlements, penalties, costs, or expenses (including reasonable attorneys’ fees) arising from:

●     The Minor’s conduct or participation in Camp;

●     Any breach of this Agreement;

●     Any claims brought by or on behalf of the Minor;

●     Damage caused by the Minor to persons, animals, or property.

This indemnification obligation applies regardless of the merit or outcome of any claim.

6. MEDICAL AUTHORIZATION

I certify that the Minor is physically, emotionally, and medically capable of safely participating in Camp activities.

In the event of illness, injury, or emergency, I authorize Purrfecto employees and representatives to obtain emergency medical care for the Minor if I cannot be reached immediately. I understand and agree that I am solely responsible for any resulting medical expenses.

Purrfecto Cat Lounge does not provide medical insurance coverage for participants.

7. CAMP RULES AND REMOVAL POLICY

I agree that the Minor will follow all camp rules, employee instructions, safety procedures, and animal-handling guidelines.

Purrfecto Cat Lounge reserves the right to immediately remove any child from Camp, without refund, for:

●     Unsafe behavior;

●     Aggressive or disruptive conduct;

●     Harassment or bullying;

●     Failure to follow staff instructions;

●     Conduct that may endanger people or animals.

8. ALLERGIES AND HEALTH DISCLOSURE

I affirm that I have disclosed all known allergies, medical conditions, behavioral conditions, medications, or special needs that may affect the Minor’s participation in Camp.

I understand that cats, cat dander, cleaning products, food items, and other environmental conditions may trigger allergic or medical reactions.

9. PHOTO AND MEDIA RELEASE (OPTIONAL)

☐ YES — I authorize Purrfecto Cat Lounge to photograph or video the Minor during Camp activities and use such images or recordings for advertising, marketing, social media, and promotional purposes without compensation.

☐ NO — I do not authorize use of the Minor’s image.

10. NO-REFUND POLICY

I acknowledge and agree that ALL CAMP FEES ARE FINAL AND NON-REFUNDABLE.

No refunds, credits, transfers, or make-up days will be provided for:

●     Illness;

●     Missed days;

●     Scheduling conflicts;

●     Early withdrawal;

●     Behavioral dismissal;

●     Voluntary cancellation;

●     Removal from Camp for rule violations.

11. GOVERNING LAW AND VENUE

This Agreement shall be governed exclusively by the laws of the State of Texas.

Any dispute arising out of or relating to this Agreement or participation in Camp shall be brought exclusively in the state courts located in Travis County, Texas, and the parties consent to the jurisdiction of such courts.

12. SEVERABILITY

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties regarding Camp participation and supersedes any prior oral or written representations.

No verbal statements or representations shall modify this Agreement.

BY SIGNING BELOW, I ACKNOWLEDGE THAT:

●     I HAVE READ THIS ENTIRE AGREEMENT;

●     I UNDERSTAND ITS TERMS;

●     I UNDERSTAND THAT I AM WAIVING IMPORTANT LEGAL RIGHTS;

●     I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY;

●     I UNDERSTAND THERE ARE NO REFUNDS.
